  1. The Florida Department of Law Enforcement (FDLE) must approve your application. If that happens, they will grant a certificate of eligibility.
  2. Upon receipt of the certificate of eligibility one of our lawyers will prepare a Petition to Seal or Expunge and submit it to the court;
  3. After filing the petition, the court will either rule on the petition without a hearing, or the court may set the petition for a hearing. Either way, the court will either grant or deny the petition.
  4. If the petition is granted, the court will issue an order to seal or expunge your criminal record.

Once you have reviewed the rules for an expungement or the sealing of your record, then you should make an appointment with our office. After an initial interview with one of our attorneys, we will then make all the necessary arraignments to begin the process, which is listed above. Below is a list of everything which we will obtain from you during that interview and what the application requires:

  • A list of all the charges in your criminal history
  • Our notary will certify the application
  • Birth Certificate
  • Fingerprints
